Chapter 1 – Introduction
Welcome to Waypilot
These Terms of Service (“Terms”) govern your access to and use of the Waypilot mobile application, website and all associated features, products and services (collectively referred to as the “Services”).
By creating an account, accessing the Services or using Waypilot in any way, you enter into a legally binding agreement with Waypilot and agree to comply with these Terms. If you do not agree to these Terms, you must not access or use the Services.
If you use the Services on behalf of a business, organisation or other legal entity, you confirm that you have the authority to accept these Terms on its behalf. In those circumstances, references to “you” and “your” include both you and the organisation you represent.
About Waypilot
Waypilot is a digital travel planning platform designed to help users organise, manage and enhance their travel experiences. Depending on your subscription and the features available at the time, the Services may include itinerary management, travel document storage, AI-powered travel assistance, booking extraction from emails, destination information, trip collaboration, recommendations, notifications and integrations with third-party providers.
Waypilot continually develops and improves its Services. New features may be introduced, existing functionality may change, and certain features may be withdrawn where necessary for technical, commercial, operational or legal reasons.
Other Documents That Apply
These Terms should be read together with the other policies that govern your use of the Services, including our Privacy Policy, Acceptable Use Policy and any subscription-specific terms that apply to your chosen plan.
Those documents form part of your agreement with Waypilot. Where there is any inconsistency between these Terms and another policy, these Terms shall take precedence unless the other policy expressly states otherwise.
Changes to these Terms
From time to time, it may be necessary to update these Terms to reflect changes in the law, improvements to the Services, changes to our business practices or new features introduced within Waypilot.
The most recent version of these Terms will always be made available through the Waypilot application and website. Where we make changes that materially affect your rights or obligations, we will take reasonable steps to notify you before those changes take effect, unless immediate changes are required for legal, security or operational reasons.
Your continued use of the Services after updated Terms become effective constitutes your acceptance of those revised Terms.
Eligibility
You may only use the Services if you are legally capable of entering into a binding agreement under the laws of your country of residence.
If you are below the age at which you can legally enter into a binding contract, you may only use the Services with the permission and supervision of a parent or legal guardian.
Waypilot reserves the right to refuse access to the Services or suspend an account where it reasonably believes that a user is not eligible to use the Services or has previously breached these Terms.
Entire Agreement
These Terms, together with any policies expressly incorporated by reference, constitute the entire agreement between you and Waypilot regarding your use of the Services. They supersede any previous agreements, understandings or representations relating to the same subject matter.
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.
Any failure by Waypilot to enforce a provision of these Terms shall not constitute a waiver of that provision or of any other rights available to Waypilot.
Chapter 2 – Definitions
In these Terms, the following words and expressions have the meanings set out below unless the context requires otherwise.
“Acceptable Use Policy” means the Waypilot Acceptable Use Policy, as amended from time to time, which forms part of these Terms.
“Account” means the registered account created by a user in order to access the Services.
“Affiliate Partner” means any third-party business that offers products or services through Waypilot or whose products or services are promoted within the Services.
“AI Concierge” means the artificial intelligence-powered travel assistant made available through the Services, together with any future artificial intelligence features introduced by Waypilot.
“Booking” means any reservation, confirmation, ticket, itinerary or other travel arrangement relating to transport, accommodation, activities or other travel services.
“Content” means any information, text, images, photographs, videos, audio recordings, documents, files, data or other material capable of being uploaded to, stored within or transmitted through the Services.
“Email Import” means the feature that enables users to forward travel-related emails to Waypilot for the purpose of extracting travel information and creating or updating Trips.
“Fees” means any subscription charges or other amounts payable by a user in connection with the Services.
“Free Plan” means any version of the Services made available without payment of a subscription fee.
“Intellectual Property Rights” means all copyright, database rights, trade marks, trade names, domain names, patents, design rights, trade secrets, confidential information and any other intellectual property rights, whether registered or unregistered, anywhere in the world.
“Privacy Policy” means the Waypilot Privacy Policy, as amended from time to time.
“Pro Subscription” means any paid subscription offered by Waypilot that provides access to premium features or enhanced usage allowances.
“Services” means the Waypilot mobile application, website and all associated software, features, products and services provided by Waypilot from time to time.
“Subscription” means any paid plan purchased by a user which grants access to premium features for the applicable billing period.
“Third-Party Service” means any website, application, software, platform or service that is owned or operated by a person or organisation other than Waypilot.
“Trip” means a collection of travel-related information created within the Services, including itineraries, bookings, travel documents, notes, photographs, destinations and associated information.
“Trip Owner” means the user who creates a Trip or otherwise has administrative control over that Trip.
“Trip Member” means a user who has been granted access to a Trip by the Trip Owner.
“User Content” means any Content uploaded, created, submitted, transmitted, synchronised or otherwise made available by a user through the Services.
“Waypilot”, “we”, “our” and “us” mean the operator of the Waypilot Services.
“You” and “your” mean the individual or legal entity accessing or using the Services.
Unless the context requires otherwise, words importing the singular include the plural and vice versa, references to one gender include all genders, and references to legislation include any amendment, replacement or re-enactment of that legislation. References to “including”, “includes” or similar expressions shall be interpreted as meaning “including without limitation.”
Chapter 3 – Accounts and Eligibility
Creating an Account
To access certain features of the Services, you must create a Waypilot account. When creating an account, you agree to provide information that is accurate, complete and up to date. You are responsible for ensuring that your account information remains accurate throughout your use of the Services.
Waypilot may require you to verify your email address or complete other verification procedures before you can access some or all of the Services.
You must not create an account using false or misleading information, impersonate another person or organisation, or create an account on behalf of another individual without their authority.
Eligibility
You may only create an account if you are legally capable of entering into a binding agreement under the laws of your country of residence.
If you are under the minimum legal age to enter into such an agreement, you may only use the Services with the permission and supervision of a parent or legal guardian, who accepts these Terms on your behalf.
By creating an account, you confirm that you satisfy these eligibility requirements.
Account Security
You are responsible for maintaining the confidentiality of your account credentials, including your password and any authentication methods associated with your account.
You must take reasonable steps to prevent unauthorised access to your account and should use a strong, unique password. You must notify Waypilot as soon as reasonably practicable if you become aware of any unauthorised use of your account or any suspected security breach.
Unless required by applicable law, Waypilot is not responsible for any loss or damage arising from your failure to keep your account credentials secure.
One Account Per User
Unless expressly authorised by Waypilot, each individual may maintain only one personal account. Creating multiple accounts to circumvent subscription restrictions, usage limits, promotional offers or enforcement action is prohibited.
Nothing in this section prevents you from being invited to collaborate on another user’s Trip using your existing account.
Suspension and Closure of Accounts
You may close your account at any time using the functionality provided within the Services or by contacting Waypilot.
Waypilot may suspend, restrict or terminate an account where it reasonably believes that:
- these Terms or the Acceptable Use Policy have been breached;
- the account has been used fraudulently or unlawfully;
- the security or integrity of the Services is at risk;
- the account has remained inactive for an extended period and continued retention is no longer necessary; or
- Waypilot is required to do so by law or a competent authority.
Where reasonably practicable, Waypilot will notify you before suspending or terminating your account and provide an opportunity to remedy the issue. This does not apply where immediate action is necessary to protect the Services, other users, or to comply with a legal obligation.
Account Deletion
If your account is closed, your access to the Services will cease. Any ongoing subscriptions will be dealt with in accordance with Chapter 14 (Subscriptions and Payments), and the handling of your personal data will be governed by the Privacy Policy.
Certain information may continue to be retained where required to comply with legal obligations, resolve disputes, prevent fraud, enforce these Terms or protect the legitimate interests of Waypilot or other users.
Where a Trip has been shared with other users, deletion of your account may affect your access to that Trip but will not necessarily remove the Trip or its contents if another user continues to own or administer it.
Future Access
If your account has been suspended or terminated for a breach of these Terms, you must not create a new account without Waypilot’s prior written permission. Waypilot reserves the right to refuse registration where it reasonably believes that a new account has been created to circumvent a previous suspension or termination.
Chapter 4 – The Services
Our Services
Waypilot is a digital travel planning platform designed to help users organise, manage and enhance their travel experiences. The Services are intended to provide a central location for travel-related information and may include itinerary planning, travel document storage, destination information, AI-powered travel assistance, booking extraction, trip sharing and other travel-related features.
The features available to you may vary depending on your subscription, your device, your geographical location and the current version of the Services.
Continuous Development
Waypilot is continually developed and improved. We may introduce new features, modify existing functionality, discontinue features or make changes to the way in which the Services operate.
Whilst we will endeavour to minimise disruption, updates may occasionally affect the appearance, functionality or availability of certain features. Unless required by law, Waypilot is under no obligation to continue providing any particular feature indefinitely.
Availability
Although Waypilot aims to provide the Services on a continuous basis, we do not guarantee that the Services will always be available or operate without interruption.
The Services may occasionally be unavailable due to scheduled maintenance, emergency maintenance, software updates, technical faults, failures of third-party providers, internet outages or events beyond our reasonable control.
Where reasonably practicable, planned maintenance that is likely to cause significant disruption will be communicated in advance.
Travel Information
Waypilot may provide travel-related information obtained from publicly available sources, licensed content providers, artificial intelligence models and other third-party services.
Although we take reasonable steps to provide useful and up-to-date information, travel information may become outdated or change without notice. Flight schedules, visa requirements, border restrictions, attraction opening times, weather conditions, public transport services, exchange rates and local laws may all change after information has been displayed within the Services.
You are responsible for verifying any information that may affect your travel arrangements before relying upon it.
AI Concierge
The AI Concierge is intended to assist with travel planning by providing information, suggestions and recommendations based on the information available to it.
Responses generated by artificial intelligence may occasionally be inaccurate, incomplete, misleading or unsuitable for your particular circumstances. The AI Concierge should therefore be regarded as a planning tool rather than a substitute for professional advice or independent verification.
You should independently verify any information relating to visas, passports, vaccinations, travel restrictions, legal requirements, health advice, transport schedules, booking conditions, pricing or other matters that may affect your travel.
Not a Travel Provider
Unless expressly stated otherwise, Waypilot is not a travel agent, tour operator, airline, accommodation provider, transport provider or travel insurance provider.
Waypilot does not own, operate or control the travel services displayed or referenced within the Services and is not responsible for their availability, pricing, quality or performance.
Any contract relating to flights, accommodation, transfers, excursions, insurance or other travel products is entered into directly between you and the relevant third-party provider.
Third-Party Integrations
Certain features of the Services may rely upon third-party platforms, software or application programming interfaces (APIs). The availability and functionality of those features may depend upon services that are outside Waypilot’s control.
Where a third-party provider changes or withdraws its service, Waypilot may modify or discontinue any affected functionality without liability, although we will seek to provide suitable alternatives where reasonably practicable.
Beta Features
From time to time, Waypilot may make experimental or beta features available to selected users for testing purposes.
Beta features are provided on an “as available” basis and may contain bugs, errors or incomplete functionality. They may be modified or withdrawn at any time without notice.
Unless expressly stated otherwise, beta features should not be relied upon for storing important travel information or making critical travel decisions.
User Responsibility
Waypilot is designed to assist you in organising your travel. You remain responsible for reviewing your itineraries, verifying imported booking information, checking travel documentation, ensuring that important information is accurate and making any decisions relating to your travel arrangements.
Your use of the Services does not transfer responsibility for your travel plans or bookings to Waypilot.
Chapter 5 – AI Concierge
Purpose of the AI Concierge
The AI Concierge is an artificial intelligence-powered assistant designed to support users in planning, organising and managing their travel. Depending on the features available at the time, the AI Concierge may assist with destination research, itinerary planning, travel recommendations, transport information, local attractions, budgeting, packing advice and other travel-related enquiries.
The AI Concierge is intended to enhance your travel planning experience and should be regarded as a convenience tool rather than a substitute for your own judgement or independent research.
AI-Generated Responses
The AI Concierge generates responses using artificial intelligence and other automated technologies. Whilst Waypilot aims to provide helpful and relevant information, AI-generated responses may occasionally be inaccurate, incomplete, outdated or inappropriate for your particular circumstances.
The AI Concierge does not possess human judgement and should not be relied upon as the sole source of information when making travel decisions.
You remain responsible for evaluating any information provided and determining whether it is appropriate for your own circumstances.
Verification of Information
Certain types of travel information are subject to frequent change and should always be verified through official or authorised sources before you act upon them.
This includes, but is not limited to, passport validity requirements, visa requirements, entry restrictions, customs regulations, vaccination requirements, health advice, local laws, transport schedules, booking conditions, weather warnings, exchange rates and pricing.
Waypilot accepts no responsibility for losses arising from reliance upon information that has changed or was inaccurate at the time it was generated.
Recommendations
The AI Concierge may recommend destinations, attractions, restaurants, accommodation, transport providers, activities or other travel-related services.
Recommendations are generated using a combination of artificial intelligence, publicly available information, licensed data and, where applicable, your own travel preferences. They should not be interpreted as endorsements or guarantees of quality, suitability, availability or value for money.
Any decision to book or use a recommended service remains entirely your responsibility.
Personalised Assistance
Where you choose to provide travel preferences, previous travel history, saved Trips or other information, the AI Concierge may use that information to personalise its responses.
Personalised responses are generated automatically and may not always reflect your current circumstances or preferences. You should review any recommendations before relying upon them.
Travel Decisions
Waypilot does not make travel decisions on your behalf.
The AI Concierge may suggest possible options or identify matters that you may wish to consider, but all decisions relating to your travel arrangements remain your responsibility.
You are responsible for ensuring that any travel arrangements you make are suitable for your individual circumstances, including the needs of anyone travelling with you.
Professional Advice
The AI Concierge is not intended to provide legal, financial, medical, immigration or other professional advice.
Where a response concerns matters that could significantly affect your legal rights, health, finances or ability to travel, you should obtain advice from an appropriately qualified professional or consult the relevant official authority.
Appropriate Use
The AI Concierge is provided primarily for travel planning and travel-related assistance.
You must not use the AI Concierge as a substitute for a general-purpose artificial intelligence platform or in a manner that is inconsistent with the Acceptable Use Policy. In particular, you must not use the AI Concierge to operate automated workflows, generate excessive volumes of non-travel content, or otherwise use the Services for purposes unrelated to travel.
Waypilot reserves the right to implement reasonable safeguards to protect the availability, security and integrity of the AI Concierge for all users.
Availability and Improvement
The AI Concierge is an evolving feature and may be updated, modified, replaced or temporarily unavailable from time to time.
Waypilot may introduce new artificial intelligence models, retire existing models or change the way responses are generated in order to improve performance, reliability or user experience.
The availability of particular AI features may vary depending on your subscription, device, geographical location or other operational factors.
No Guarantee
Whilst Waypilot aims to provide a helpful and reliable AI Concierge, no guarantee is given that every response will be accurate, complete, suitable or free from error.
To the fullest extent permitted by applicable law, Waypilot disclaims any warranty that the AI Concierge will meet your individual requirements or produce a particular outcome.
You acknowledge that the AI Concierge is intended to assist your travel planning and not to replace your own judgement or independent verification of important information.
Chapter 6 – Email Import and Booking Extraction
Purpose of the Feature
Waypilot may allow you to forward travel-related emails to a designated email address or connect other supported services for the purpose of extracting booking information and creating or updating Trips.
This feature is designed to reduce the amount of manual data entry required when organising travel. It uses automated technologies, including artificial intelligence, to identify travel-related information contained within emails and, where applicable, their attachments.
Your Responsibility
You should only forward emails that you are authorised to access and which relate to your own travel or the travel of persons on whose behalf you are authorised to act.
You remain responsible for ensuring that any information extracted from your emails is accurate, complete and suitable for your intended use.
Before relying on any itinerary, booking or travel information generated through the Email Import feature, you should review the extracted information and correct any errors or omissions.
Accuracy of Extraction
Whilst Waypilot aims to extract booking information accurately, automated extraction is not infallible.
Travel confirmations issued by airlines, hotels, rail operators, tour providers and other organisations vary considerably in their format and content. As a result, Waypilot cannot guarantee that every booking, travel date, passenger name, reservation number, destination or other detail will be identified correctly.
Information may occasionally be incomplete, duplicated, omitted or interpreted incorrectly.
You remain responsible for reviewing all extracted information before relying upon it.
Supported Bookings
Waypilot may support the extraction of information from a wide range of travel-related confirmations, including flights, accommodation, rail travel, ferry bookings, car hire, airport transfers, excursions, travel insurance and similar services.
Support for particular booking providers may change over time and Waypilot does not guarantee compatibility with every travel company or email format.
Email Content
In order to provide the Email Import feature, Waypilot may process the contents of forwarded emails and any attachments necessary to identify travel-related information.
Only the information reasonably required to provide the feature will be processed in accordance with the Privacy Policy.
Waypilot does not claim ownership of your emails or their contents.
Failed or Partial Imports
An email may fail to import, or only part of its contents may be extracted, for a variety of reasons including unsupported formats, corrupted attachments, encrypted documents, image quality, provider-specific formatting or technical errors.
Where an import is unsuccessful, you may choose to enter the relevant travel information manually or upload alternative documentation where supported.
Waypilot is under no obligation to successfully process every email or travel document submitted through the Services.
Duplicate Bookings
Waypilot may attempt to identify duplicate bookings where similar travel information has already been imported.
Despite reasonable efforts to prevent duplication, duplicate itinerary items or bookings may occasionally occur. Users should review their Trips periodically and remove any duplicate information where necessary.
Changes After Import
The Email Import feature reflects the information available at the time an email is processed.
If your booking is subsequently amended, cancelled or replaced by the travel provider, Waypilot may not automatically detect those changes unless updated information is received and successfully processed.
It remains your responsibility to ensure that your Trip reflects your current travel arrangements.
Availability
The Email Import feature depends upon the continued availability of third-party email services, document formats and supporting technologies.
Waypilot may modify, suspend or discontinue this feature, either generally or in relation to particular providers, where reasonably necessary due to technical, operational, legal or commercial reasons.
Limitation of Responsibility
The Email Import feature is provided solely as a convenience to assist with travel planning.
Waypilot does not warrant that information extracted from emails will be complete, accurate or suitable for any particular purpose. The creation of a Trip, itinerary or booking within the Services should not be treated as confirmation that the underlying travel arrangements are valid, current or correctly recorded.
You remain responsible for checking all travel documentation issued by the relevant travel provider and for ensuring that your travel arrangements are accurate before departure.
Chapter 7 – Trips and User Content
Your Trips
Waypilot enables you to create and manage Trips for the purpose of organising your travel. A Trip may include itineraries, bookings, travel documents, notes, photographs, destination information, reminders and other travel-related content.
You are responsible for the content of your Trips and for ensuring that the information you choose to store is accurate, lawful and appropriate.
Waypilot does not independently verify the accuracy of the information contained within your Trips.
Ownership of Your Content
You retain ownership of all User Content that you upload, create or otherwise make available through the Services.
Nothing in these Terms transfers ownership of your User Content to Waypilot.
Licence Granted to Waypilot
In order to operate the Services, you grant Waypilot a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, adapt, transmit and display your User Content solely to the extent necessary to:
- provide and maintain the Services;
- synchronise your data across your devices;
- process travel documents and bookings;
- enable authorised sharing and collaboration;
- generate AI-powered travel assistance;
- create backups and maintain service resilience;
- investigate security incidents or suspected misuse; and
- comply with applicable law or lawful requests from public authorities.
This licence continues only for as long as your User Content remains within the Services, except where continued retention is required by law or as described in the Privacy Policy.
Waypilot will not sell your User Content to third parties.
Responsibility for User Content
You are solely responsible for the User Content that you upload or otherwise make available through the Services.
By uploading User Content, you confirm that:
- you own the content or have the necessary rights and permissions to use it;
- the content does not infringe the intellectual property or privacy rights of any other person;
- the content does not breach any applicable law;
- the content does not contain malicious software or other harmful code; and
- you have the authority to upload any personal information relating to another individual where required.
Prohibited Content
You must not upload, store or distribute User Content that:
- is unlawful, fraudulent or misleading;
- infringes copyright, trade marks or other intellectual property rights;
- contains malicious software or harmful code;
- promotes violence, terrorism or criminal activity;
- exploits or endangers children;
- contains non-consensual intimate imagery;
- infringes another person’s privacy or data protection rights; or
- otherwise breaches the Acceptable Use Policy.
Waypilot reserves the right to remove or restrict access to User Content where it reasonably believes that it breaches these Terms or applicable law.
Storage of User Content
The Services are intended to store information that is directly related to travel planning and travel management.
Whilst Waypilot does not impose fixed storage limits on certain subscription plans, the storage facilities provided through the Services must not be used as a substitute for general-purpose cloud storage or online backup services.
The storage of User Content remains subject to the Acceptable Use Policy.
Data Loss
Although Waypilot implements reasonable measures to protect User Content, no online service can guarantee that data will never be lost, corrupted or become temporarily unavailable.
Users are encouraged to retain original copies of important travel documents, passports, visas, insurance documents and other critical records.
Waypilot shall not be responsible for losses arising solely from a user’s failure to retain independent copies of important documents.
Removal of Content
You may delete your User Content at any time using the functionality provided within the Services.
Deletion requests will normally take effect immediately within your account, although copies may remain in encrypted backups or archived systems for a limited period where necessary for disaster recovery, legal compliance, fraud prevention or other legitimate operational purposes.
Further information regarding the retention and deletion of personal data is provided within the Privacy Policy.
Content Moderation
Waypilot does not routinely monitor all User Content uploaded to the Services.
However, where we become aware of content that we reasonably believe breaches these Terms, infringes the rights of another person, presents a security risk or is otherwise unlawful, we may investigate the matter and remove, restrict or disable access to the relevant content without prior notice where reasonably necessary.
Where appropriate, we may also suspend the associated account pending the outcome of our investigation.
Public Content
Unless a feature expressly states otherwise, User Content uploaded to Waypilot is private and is only accessible to you and those users to whom you have deliberately granted access.
Waypilot will not make your Trips or User Content publicly available without your consent, except where required by law or necessary to comply with a valid legal request.
Chapter 8 – Trip Sharing and Collaboration
Sharing Trips
Waypilot may allow you to share a Trip with other registered users of the Services. Sharing a Trip enables invited users to view or contribute to travel information in accordance with the permissions you choose to grant.
Trip sharing is intended to support collaborative travel planning between family members, friends, colleagues or other authorised individuals.
Trip Ownership
The user who creates a Trip is the Trip Owner unless ownership is transferred using functionality provided by Waypilot.
The Trip Owner retains overall control of the Trip, including the ability to invite or remove Trip Members, manage permissions and, where supported, transfer ownership to another user.
Unless ownership is transferred, sharing a Trip does not affect the Trip Owner’s rights or responsibilities in relation to that Trip.
Permissions
When sharing a Trip, the Trip Owner may assign different levels of access to each Trip Member.
Depending on the functionality available within the Services, permissions may allow a Trip Member to view information, add new content, edit existing content or perform other actions authorised by the Trip Owner.
Trip Members must only use the permissions granted to them and must not attempt to circumvent or exceed those permissions.
Responsibility for Shared Content
Each user remains responsible for the content that they upload, edit or otherwise contribute to a shared Trip.
Waypilot does not verify which user created or modified particular content and accepts no responsibility for disagreements arising between Trip Owners and Trip Members regarding the management of shared Trips.
Users are encouraged to communicate directly with one another regarding any proposed changes to shared travel plans.
Removing Access
The Trip Owner may remove a Trip Member’s access at any time using the functionality provided within the Services.
Once access has been removed, the former Trip Member will no longer be able to access the shared Trip unless they are invited again.
Removing access does not automatically remove any content that the former Trip Member previously contributed to the Trip, unless the Services expressly provide functionality to do so.
Leaving a Shared Trip
A Trip Member may choose to leave a shared Trip at any time.
Leaving a Trip removes that user’s access to future updates but does not automatically remove content that they previously contributed, unless otherwise provided by the Services.
Ownership of Contributed Content
Each user retains ownership of the User Content that they contribute to a shared Trip.
However, by contributing content to a shared Trip, you acknowledge that other authorised Trip Members may continue to access and use that content for the purposes of planning and managing the shared journey, unless it is subsequently removed in accordance with the functionality of the Services.
Availability of Shared Trips
A shared Trip may become unavailable if it is deleted by the Trip Owner, if access permissions are withdrawn, if the Trip Owner deletes their account, or where Waypilot removes the Trip in accordance with these Terms or applicable law.
Waypilot does not guarantee that a shared Trip will remain available indefinitely.
Privacy
Users should exercise appropriate care when sharing Trips that contain personal information, travel documentation or other sensitive material.
By inviting another user to a Trip, you acknowledge that they may be able to view the information made available to them through the permissions you have granted.
Waypilot is not responsible for the actions of Trip Members once they have been granted legitimate access to a shared Trip.
Disputes Between Users
Waypilot is not responsible for resolving disputes between Trip Owners and Trip Members concerning shared Trips, permissions, travel arrangements or contributed content.
Where a dispute affects the security or operation of the Services, Waypilot may take reasonable steps to protect the platform, including temporarily restricting access to the relevant Trip while the matter is investigated.
Nothing in this section prevents Waypilot from complying with a legal obligation or a valid request from a competent authority.
Chapter 9 – Third-Party Services and Affiliate Partners
Third-Party Services
The Services may include links to, integrations with or information relating to products and services provided by third parties. These may include, without limitation, airlines, hotels, accommodation providers, transport operators, travel insurance providers, airport transfer services, excursion providers, mapping services, weather services, currency providers and other travel-related businesses.
These third-party services are provided independently of Waypilot and remain subject to their own terms, conditions and privacy policies.
No Endorsement
Unless expressly stated otherwise, the inclusion of a third-party service within Waypilot does not constitute an endorsement, recommendation or guarantee of that service.
Whilst Waypilot seeks to work with reputable providers, we do not warrant the quality, safety, availability, suitability or legality of any third-party products or services.
Any ratings, reviews, recommendations or other information presented within the Services are provided for general informational purposes only.
Your Relationship with Third Parties
Where you purchase, reserve or otherwise obtain a product or service from a third-party provider, your contract is formed directly with that provider and not with Waypilot.
The third-party provider is solely responsible for fulfilling your booking, delivering the relevant service and responding to any enquiries, complaints, cancellations, refunds or compensation claims relating to that booking.
Waypilot is not a party to those agreements and accepts no responsibility for the performance or non-performance of any third-party provider.
Affiliate Partnerships
Waypilot may participate in affiliate or referral programmes with selected third-party providers.
Where you choose to purchase a product or service through an affiliate link or referral provided within the Services, Waypilot may receive a commission or other form of compensation from the relevant provider.
Any commission received does not increase the price you pay unless expressly stated by the provider.
Waypilot endeavours to ensure that affiliate relationships do not influence the impartiality of travel information or recommendations provided through the Services.
Availability of Third-Party Services
Third-party products and services may change, become unavailable or be withdrawn without notice.
Waypilot does not guarantee that any particular provider, product, destination, offer or promotion will remain available within the Services for any specific period.
We reserve the right to add, remove or replace third-party integrations at any time where reasonably necessary.
Third-Party Content
Certain information displayed within the Services may originate from third-party data providers or public sources.
Although Waypilot takes reasonable steps to present accurate information, we cannot guarantee the completeness, accuracy or continued availability of third-party content.
You should verify important information directly with the relevant provider before making travel decisions or completing a booking.
External Websites
The Services may contain links to websites or applications operated by third parties.
Waypilot is not responsible for the content, security, availability or privacy practices of external websites or applications. Your use of those websites is entirely at your own risk and is governed by the terms and policies of the relevant operator.
Limitation of Responsibility
To the fullest extent permitted by applicable law, Waypilot shall not be liable for any loss, damage, delay, cancellation, additional expense or other issue arising from the acts, omissions or failures of any third-party provider.
This includes, without limitation, changes to flight schedules, accommodation cancellations, transport delays, supplier insolvency, inaccurate pricing, unavailable services or any other matter outside Waypilot’s reasonable control.
Nothing in this section excludes or limits any liability that cannot lawfully be excluded under applicable law.
Future Integrations
Waypilot may introduce additional integrations with third-party services from time to time in order to enhance the functionality of the Services.
The availability of particular integrations may depend on your subscription, geographical location, device compatibility or the continued availability of the relevant third-party service.
Waypilot does not guarantee that any integration will remain available indefinitely.
Chapter 10 – Subscriptions, Payments and Free Trials
Subscription Plans
Waypilot may offer both free and paid subscription plans. The features available under each plan, together with the applicable pricing, will be described within the Services or on the Waypilot website at the time of purchase.
Waypilot reserves the right to introduce new subscription plans, modify existing plans or discontinue plans, provided that any changes affecting an existing subscription are made in accordance with these Terms.
Purchasing a Subscription
Subscriptions may be purchased through the Apple App Store, Google Play Store or any other authorised payment provider supported by Waypilot.
By purchasing a Subscription, you authorise the relevant payment provider to charge the applicable subscription fee together with any taxes or other charges required by law.
Your purchase is also subject to the terms and conditions of the relevant app store or payment provider.
Billing
Unless otherwise stated, subscriptions are billed in advance for the selected billing period.
Your subscription will commence once payment has been successfully processed and will continue until it expires or is cancelled in accordance with these Terms.
Subscription fees are displayed before you complete your purchase and include any applicable taxes where required by law.
Automatic Renewal
Unless you cancel your Subscription before the end of the current billing period, it will automatically renew for successive periods of the same duration.
The renewal fee will be charged using the payment method associated with your Apple App Store, Google Play Store or other authorised payment account.
It is your responsibility to ensure that your payment details remain valid and up to date.
Cancelling a Subscription
You may cancel your Subscription at any time through the relevant app store or payment provider.
Cancellation prevents future renewals but does not normally entitle you to a refund for the remainder of the current billing period unless required by applicable law or the policies of the relevant payment provider.
Following cancellation, you will continue to have access to your subscription benefits until the end of the period already paid for.
Price Changes
Waypilot may change the price of its Subscription plans from time to time.
Where a price increase affects an existing subscription, reasonable notice will be provided where required by applicable law or by the policies of the relevant app store.
If you do not agree to the revised price, you may cancel your Subscription before the new price takes effect.
Free Trials and Promotional Offers
Waypilot may, from time to time, offer free trials, introductory pricing or promotional offers.
Unless otherwise stated, free trials are available only to new subscribers and may be limited to one trial per user, payment account or device.
At the end of any free trial, your Subscription may automatically convert into a paid Subscription unless you cancel before the trial period expires.
Waypilot reserves the right to withdraw or modify promotional offers at any time, provided that doing so does not affect promotions that have already been redeemed.
Refunds
Subscription purchases are generally processed by the Apple App Store, Google Play Store or another authorised payment provider.
Where your purchase has been made through an app store, requests for refunds must normally be submitted directly to the relevant store and will be considered in accordance with its refund policies.
Where Waypilot processes payments directly, refund requests will be considered in accordance with applicable consumer protection legislation and any published refund policy.
Nothing in these Terms affects any statutory rights that cannot be excluded under applicable law.
Downgrading or Upgrading
You may upgrade or downgrade your Subscription where such functionality is supported.
Any changes to your subscription will take effect in accordance with the billing rules of the relevant payment provider.
Changes between subscription plans may result in changes to the features or usage allowances available to your account.
Suspension for Non-Payment
If a subscription payment cannot be successfully collected, Waypilot or the relevant payment provider may suspend or terminate access to paid features until payment has been successfully received.
Waypilot is not responsible for interruptions to subscription access resulting from failed payments, expired payment methods or actions taken by third-party payment providers.
Changes to Subscription Features
Waypilot may add, improve, modify or discontinue subscription features as the Services evolve.
Where a change materially reduces the core benefits of an active Subscription, Waypilot will endeavour to provide reasonable notice where practicable.
Minor improvements, interface changes, performance enhancements or feature refinements shall not constitute a material reduction in subscription benefits.
Taxes
You are responsible for any taxes, duties or similar governmental charges applicable to your purchase, except where Waypilot is required by law to collect and remit such amounts on your behalf.
Any taxes collected as part of your purchase will be displayed during the checkout process where required.
No Guarantee of Future Pricing
Unless expressly stated otherwise, Waypilot does not guarantee that any introductory price, promotional offer or subscription fee will remain available for future renewals or subsequent purchases.
Any promotional pricing applies only for the period expressly stated at the time of purchase.
Chapter 11 – Intellectual Property
Ownership of the Services
The Services, including the Waypilot application, website, software, design, branding, logos, graphics, user interface, databases, source code, AI functionality and all associated content made available by Waypilot, are owned by or licensed to Waypilot and are protected by copyright, trade mark, database and other intellectual property laws.
Except as expressly permitted by these Terms, nothing in these Terms grants you any ownership rights in the Services or any intellectual property belonging to Waypilot or its licensors.
Licence to Use the Services
Subject to your compliance with these Terms, Waypilot grants you a limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to access and use the Services for your own personal, non-commercial travel planning purposes.
This licence continues only for as long as you comply with these Terms and does not permit any use of the Services beyond that expressly authorised.
Restrictions
Unless expressly permitted by applicable law or by Waypilot in writing, you must not:
- copy, reproduce or redistribute any part of the Services;
- modify, adapt or create derivative works from the Services;
- reverse engineer, decompile or otherwise attempt to discover the source code of the Services;
- remove or obscure any copyright, trade mark or proprietary notices;
- sell, licence, lease or commercially exploit any part of the Services;
- use the Services to develop or train a competing product or artificial intelligence model; or
- use automated means to extract substantial portions of the Services or their content.
Nothing in this section restricts rights that cannot lawfully be excluded under applicable law.
Waypilot Trade Marks
“Waypilot”, the Waypilot name, logo, branding and any associated trade marks, whether registered or unregistered, are the property of Waypilot or its licensors.
You must not use any Waypilot trade mark, logo or branding without prior written permission, except where such use is expressly permitted by applicable law.
Third-Party Intellectual Property
The Services may display the names, logos, trade marks or other intellectual property of third parties.
All such intellectual property remains the property of its respective owner. Nothing in these Terms grants you any right to use third-party intellectual property except as necessary for your personal use of the Services.
Feedback
Waypilot welcomes suggestions, ideas and feedback relating to the Services.
If you choose to provide feedback, feature requests, bug reports or other suggestions, you grant Waypilot a perpetual, worldwide, irrevocable, royalty-free licence to use, modify, implement, publish and incorporate that feedback into the Services without compensation or acknowledgement.
This provision does not transfer ownership of any intellectual property that exists independently of the feedback itself.
User Content
Ownership of User Content remains with the user who created or uploaded it.
The licence granted by you to Waypilot in respect of User Content is set out in Chapter 7 (Trips and User Content). Nothing in this chapter transfers ownership of your User Content to Waypilot.
Copyright Complaints
Waypilot respects the intellectual property rights of others.
If you believe that material available through the Services infringes your copyright or other intellectual property rights, you should notify Waypilot using the contact details provided at the end of these Terms.
Your notice should include sufficient information to identify the material concerned, the rights alleged to have been infringed and evidence that you are authorised to act on behalf of the rights holder.
Waypilot will investigate legitimate complaints and, where appropriate, may remove or restrict access to the relevant content whilst the matter is considered.
Reservation of Rights
All rights not expressly granted to you under these Terms are reserved by Waypilot and its licensors.
No licence or right shall be implied by estoppel, waiver or otherwise solely because a right has not been expressly exercised by Waypilot.
Chapter 12 – Availability, Maintenance and Changes to the Services
Service Availability
Waypilot aims to provide a reliable and continuously available service. However, we do not guarantee that the Services, or any part of the Services, will be available at all times or operate without interruption.
From time to time, access to the Services may be affected by scheduled maintenance, emergency maintenance, software updates, technical faults, internet connectivity issues, failures of third-party providers or circumstances beyond Waypilot’s reasonable control.
Whilst we will use reasonable endeavours to minimise disruption, temporary interruptions are an inherent part of providing online services.
Planned Maintenance
Where reasonably practicable, Waypilot will provide advance notice of planned maintenance that is expected to significantly affect the availability of the Services.
Emergency maintenance may be carried out without prior notice where necessary to protect the security, stability or integrity of the Services.
Software Updates
Waypilot may release updates, bug fixes, security patches and new versions of the Services from time to time.
Some updates may be installed automatically, whilst others may require you to download the latest version of the application from your device’s app store.
To ensure the continued security and proper operation of the Services, you may be required to install certain updates before continuing to use some or all of the Services.
Changes to the Services
Waypilot continually develops its platform and may introduce new functionality, improve existing features or discontinue features that are no longer practical or appropriate.
Accordingly, Waypilot reserves the right to modify, replace, suspend or permanently discontinue any aspect of the Services where reasonably necessary for technical, commercial, operational, legal or security reasons.
Where practicable, material changes affecting the functionality of the Services will be communicated in advance.
Compatibility
Waypilot does not guarantee that the Services will be compatible with every device, operating system, browser or software configuration.
As technology evolves, support for older operating systems or devices may be discontinued where continued support is no longer technically feasible or commercially reasonable.
It is your responsibility to ensure that your device meets the minimum technical requirements necessary to access the Services.
Third-Party Dependencies
Certain features of the Services rely upon technologies, infrastructure or services provided by third parties, including cloud hosting providers, mapping services, artificial intelligence providers, payment processors and other external systems.
Waypilot is not responsible for interruptions or reductions in functionality resulting from failures, outages or changes affecting those third-party services.
Security Measures
Waypilot may temporarily suspend access to all or part of the Services where reasonably necessary to investigate suspected security incidents, prevent unauthorised access, mitigate cyber threats or protect the integrity of the platform.
Such measures will only be maintained for as long as reasonably necessary to address the relevant issue.
Beta and Experimental Features
From time to time, Waypilot may introduce beta, preview or experimental features to selected users.
Such features are provided for evaluation purposes and may contain defects, operate inconsistently or be withdrawn without notice.
Unless expressly stated otherwise, beta features should not be relied upon for critical travel planning or the storage of important information.
Force Majeure
Waypilot shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control.
Such circumstances include, without limitation, acts of God, natural disasters, epidemics, pandemics, war, terrorism, civil unrest, industrial disputes, governmental action, failures of telecommunications networks, internet outages, power failures, cyber-attacks or failures affecting third-party service providers.
No Guaranteed Availability
Whilst Waypilot will use reasonable skill and care in providing the Services, nothing in these Terms shall be interpreted as guaranteeing uninterrupted access, continuous availability or error-free operation.
The Services are provided on an evolving basis, and occasional interruptions, modifications and maintenance activities are an expected part of their operation.
Chapter 13 – Disclaimers and Limitation of Liability
General Disclaimer
Waypilot is provided as a travel planning and organisational tool. Whilst we use reasonable skill and care in developing and maintaining the Services, we do not guarantee that the Services will always be available, uninterrupted, secure or free from errors.
The Services are intended to assist you in planning and managing your travel. They do not replace your own judgement, independent verification or professional advice where appropriate.
Travel Information
Travel information, including destination guidance, transport information, visa requirements, weather information, exchange rates, local customs, attraction details and similar content, may be obtained from publicly available sources, third-party providers or artificial intelligence.
Such information may change without notice and may become inaccurate or outdated.
You remain responsible for confirming all information that is relevant to your travel plans with the appropriate official authorities or service providers before travelling.
AI-Generated Content
Responses generated by the AI Concierge are produced automatically using artificial intelligence.
Although Waypilot seeks to provide useful and relevant responses, artificial intelligence can generate inaccurate, incomplete or misleading information.
You should not rely solely upon AI-generated responses when making travel decisions, particularly where those decisions relate to passports, visas, immigration requirements, health advice, vaccinations, legal obligations, transport schedules or financial commitments.
No Professional Advice
Nothing contained within the Services constitutes legal, financial, medical, immigration or other professional advice.
Where professional advice is required, you should consult an appropriately qualified adviser or the relevant competent authority.
No Guarantee of Third-Party Services
Waypilot does not guarantee the availability, quality, safety, legality or suitability of any third-party products or services referenced within the Services.
Flights, accommodation, transfers, excursions, insurance products and other travel services remain the responsibility of the relevant provider.
Waypilot is not responsible for delays, cancellations, overbookings, insolvency, changes in pricing or any failure by a third-party provider to deliver the services you have booked.
Limitation of Liability
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under the laws of England and Wales or any other applicable law.
Subject to the preceding paragraph, Waypilot shall not be liable for any indirect, consequential, incidental or special loss arising out of or in connection with your use of the Services.
This includes, without limitation, loss of profits, loss of business opportunity, loss of revenue, loss of anticipated savings, loss of goodwill, loss of data or business interruption, whether arising in contract, tort (including negligence), breach of statutory duty or otherwise.
Maximum Liability
To the fullest extent permitted by applicable law, Waypilot’s total aggregate liability arising from or relating to your use of the Services shall not exceed:
- where you have purchased a paid Subscription, the total subscription fees actually paid by you to Waypilot during the twelve (12) months immediately preceding the event giving rise to the claim; or
- where you have not paid Waypilot any subscription fees, ten pounds sterling (£10).
This limitation applies regardless of the number of claims made or the legal basis upon which they are brought.
Events Outside Our Control
Waypilot shall not be responsible for losses arising from circumstances beyond our reasonable control, including failures of telecommunications networks, internet service providers, cloud hosting providers, artificial intelligence providers, payment processors or other third-party infrastructure upon which the Services depend.
Your Responsibility
You acknowledge that you are solely responsible for:
- reviewing and verifying your travel arrangements;
- ensuring that passports, visas and other travel documentation are valid;
- checking transport schedules and booking confirmations;
- complying with the laws and entry requirements of the countries you visit; and
- maintaining appropriate travel insurance where necessary.
Your use of Waypilot does not transfer these responsibilities to us.
Consumer Rights
Nothing in these Terms excludes, restricts or limits any statutory rights that you may have as a consumer under applicable law, including your rights under the Consumer Rights Act 2015.
Where any provision of these Terms is found to be unenforceable under applicable consumer protection legislation, that provision shall be interpreted or modified to the minimum extent necessary so that the remainder of these Terms remains in full force and effect.
Chapter 14 – Suspension and Termination
Your Right to Stop Using the Services
You may stop using the Services at any time.
You may also close your Waypilot account using the functionality provided within the Services or by contacting Waypilot. Closing your account will end your access to the Services, although certain information may continue to be retained in accordance with our Privacy Policy and applicable law.
If you have an active Subscription, cancellation of your account does not automatically entitle you to a refund. Subscription charges and cancellations are governed by Chapter 10 of these Terms.
Our Right to Suspend or Restrict Access
Waypilot may suspend or restrict access to all or part of the Services where we reasonably believe that such action is necessary to:
- protect the security, integrity or availability of the Services;
- investigate suspected fraud, abuse or unlawful activity;
- prevent unauthorised access to user accounts or data;
- comply with a legal obligation or the lawful request of a competent authority;
- protect the rights, property or safety of Waypilot, our users or third parties; or
- investigate a suspected breach of these Terms or the Acceptable Use Policy.
Where reasonably practicable, we will notify you of any suspension and explain the reasons for our decision.
Immediate suspension may be necessary where delaying action would create a security risk, expose Waypilot or other users to harm, or prevent us from complying with our legal obligations.
Termination by Waypilot
Waypilot may terminate your account and your right to use the Services where:
- you commit a serious or repeated breach of these Terms;
- you repeatedly breach the Acceptable Use Policy;
- your use of the Services is unlawful or fraudulent;
- you provide false or misleading information when creating or using your account;
- you attempt to interfere with the operation or security of the Services; or
- continued provision of the Services to you would expose Waypilot to legal or regulatory risk.
Unless immediate termination is justified, Waypilot will normally seek to notify you of the issue and, where appropriate, provide an opportunity to remedy the breach before terminating your account.
Effect of Termination
Upon termination of your account:
- your licence to use the Services ends immediately;
- you must cease using the Services;
- access to your Trips, User Content and other account information may no longer be available;
- any active Trip sharing permissions may cease to apply; and
- any remaining obligations under these Terms that are intended to survive termination shall continue in force.
Termination does not affect any rights or liabilities that arose before the date of termination.
Retrieval of Your Information
Where reasonably practicable and technically feasible, Waypilot may allow you to export or retrieve certain information from your account before it is permanently deleted.
Waypilot is not obliged to retain User Content indefinitely following account closure or termination and may permanently delete your information in accordance with our data retention practices and Privacy Policy.
You are responsible for retaining copies of any information that you wish to keep before requesting the deletion of your account.
Re-Registration
If your account has been terminated for a breach of these Terms or the Acceptable Use Policy, you must not create another account without our prior written permission.
Waypilot reserves the right to refuse future registrations where we reasonably believe that a new account has been created to circumvent a suspension, termination or other enforcement action.
Survival of Certain Provisions
Termination or expiry of these Terms shall not affect any provisions which, by their nature, are intended to continue after your use of the Services has ended.
This includes, without limitation, provisions relating to intellectual property, User Content licences, payment obligations, disclaimers, limitation of liability, dispute resolution, governing law and any other provisions necessary to give effect to these Terms after termination.
Chapter 15 – Privacy
Your Privacy
Your privacy is important to us.
Our collection, use, storage and sharing of personal data is governed by our Privacy Policy, which forms part of these Terms. By using the Services, you acknowledge that your personal data will be processed in accordance with the Privacy Policy.
Your Responsibilities
You are responsible for ensuring that any information you upload to the Services is accurate and that you have the necessary rights and permissions to upload it.
Where you upload information relating to another individual, you confirm that you are authorised to do so and that doing so complies with applicable law.
Service Communications
Waypilot may send you communications that are necessary for the operation of your account and the Services, including security notifications, booking import updates, subscription information and notices relating to these Terms.
Marketing communications will only be sent where permitted by applicable law, and you may opt out of receiving them at any time.

Chapter 16 – Changes to these Terms
Updates to the Terms
Waypilot may update these Terms from time to time to reflect changes to the Services, applicable laws, regulatory requirements, security practices or our business operations.
We will only make changes where we reasonably consider them to be necessary or appropriate.
Notification of Changes
Where we make material changes that affect your rights or obligations, we will take reasonable steps to notify you before those changes take effect. Notification may be provided through the Services, by email or by another appropriate method.
Minor changes, including corrections, clarifications, formatting updates or changes that do not materially affect your rights, may take effect immediately without prior notice.
Acceptance of Updated Terms
By continuing to use the Services after updated Terms come into effect, you agree to be bound by the revised Terms.
If you do not agree with the updated Terms, you must stop using the Services and, where applicable, cancel any active Subscription.
Previous Versions
The most current version of these Terms will always be made available through the Waypilot website or within the Services.
Previous versions may be retained for record-keeping purposes but will no longer apply once the revised Terms take effect unless otherwise required by law.
Chapter 17 – Governing Law and Dispute Resolution
Governing Law
These Terms, together with any dispute or claim arising out of or in connection with them, their subject matter or their formation, shall be governed by and interpreted in accordance with the laws of England and Wales.
Resolving Disputes
If you have a concern about the Services, we encourage you to contact Waypilot first so that we have the opportunity to resolve the issue informally.
Most concerns can be resolved quickly through discussion, and we will use reasonable efforts to reach a fair outcome.
Court Jurisdiction
If a dispute cannot be resolved informally, it may be referred to the courts.
If you are a consumer residing in the United Kingdom, you may bring legal proceedings in the courts of the part of the United Kingdom in which you live. Waypilot may also bring proceedings in the courts of your place of residence where permitted by law.
If you are using the Services for business purposes, or if consumer protection legislation does not apply to your use of the Services, the courts of England and Wales shall have exclusive jurisdiction unless otherwise required by applicable law.
Consumer Rights
Nothing in these Terms limits or excludes any rights that you may have under mandatory consumer protection legislation applicable in your country of residence.
Where any provision of these Terms conflicts with mandatory consumer laws, those mandatory provisions shall prevail to the extent of the conflict.
Severability
If any provision of these Terms is found by a court or other competent authority to be unlawful, invalid or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it enforceable. If modification is not possible, the provision shall be deemed severed from these Terms.
The remaining provisions shall continue in full force and effect.
No Waiver
If Waypilot delays or chooses not to enforce any provision of these Terms, this shall not constitute a waiver of our right to enforce that provision or any other provision at a later time.
Any waiver of a right or remedy shall only be effective if made expressly in writing.
Assignment
You may not assign, transfer or otherwise dispose of any of your rights or obligations under these Terms without our prior written consent.
Waypilot may assign or transfer its rights and obligations under these Terms where reasonably necessary, including as part of a business reorganisation, merger, acquisition or sale of assets. Any such transfer will not reduce your rights under these Terms.
Entire Agreement
